7th S.D.: Top court upholds Martins win

Less than five hours after hearing arguments, the state Court of Appeals has already issued its decision upholding the earlier appellate panel, declining to order further recounts or auditing in the close 7th Senate District race -- effectively giving the final go-ahead to a Republican majority in the house of 32-30.
In part the ruling states:
"Inasmuch as a recount is not required by law, and as the approximately 70 individual ballots otherwise being contested could not have an actual impact on the election result, we decline to review the parties' remaining contentions on these cross appeals, as their arguments pertaining to these ballots are academic."

From Sen. Dean Skelos, soon-to-again-be-majority-leader, in part:
"....We have a transition that must take place and only days to do it. New Yorkers deserve a functional and orderly State Senate beginning on January 1st, and both Democrats and Republicans have an obligation to ensure it.
