7th S.D.: Top court to hear appeal

The state Court of Appeals in Albany will hear oral arguments Monday in Sen. Craig Johnson's lawsuit seeking manual recounts in the election for which courts so far have declared Mineola Mayor Jack Martins the winner by 451 votes. An Appellate Division 2nd Dept. panel ruled 4-0 Wednesday against Johnson -- but cleared the way for final action before the top court. A live Web case of the 11 a.m. session, said court spokesman Gary Spencer, will be available at this site. The case has been fast-tracked with an eye toward inaugurations on Jan. 1.
